EXPRESS INTERNATIONAL DRIVE and our affiliates, which include B&B HOTELS FLORIDA. and our holding company B&B HOTELS US Inc.
Services: is defined above and refers to all of the services offered by Hotel FLORIDIAN EXPRESS INTERNATIONAL DRIVE.

Article 2. Important information – please read
As part of our Services, we will process reservations made through the Site, and Hotel FLORIDIAN EXPRESS INTERNATIONAL DRIVE is jointly responsible for such processing with the Hotel FLORIDIAN EXPRESS INTERNATIONAL DRIVE. BY ACCESSING OR USING OUR SERVICES, YOU ACKNOWLEDGE AND UNDERSTAND THAT YOU ARE INTENTIONALLY DIRECTING US TO DISCLOSE YOUR PERSONAL DATA WITH THE HOTEL FLORIDIAN EXPRESS INTERNATIONAL DRIVE.


During the course of your reservation, independent processing can be implemented by these joint managers. Information relating to any independent processing operations is provided to you directly by the managers concerned.

By using our Services, you are sending us data and information, either personal data or non-personal data. Personal data includes all information that relates to you or which are opinion about you personally and either identify or may be used to identify you personally and therefore constitute personal data (collectively, “personal data”).
This is particularly the case when you use our Services to book a room.
We strive to ensure that you are informed of (i) the purposes for which your data is collected by us at the time of collection, including through various online data collection forms, emails sent to you, notifications on the Site; and (ii) whether certain personal data is mandatory or optional as well as the potential consequences of not providing the requested information.
Where required by applicable law, we will obtain your consent and / or allow you to object to the use of your personal data for certain purposes, such as, for example, the possibility of knowing your geographical position, sending you commercial marketing or placing third-party cookies on your devices for the purpose of monitoring the usage of our Services, and to provide targeted commercial offers and advertising based on of your areas of interest.
We only collect the following, limited types of personal data from you depending upon the device you are using and how you interact with us or use or interact with our Services:


Information relating to your identity: including title, surname, first name(s), mailing address, telephone number, email addresses, date of birth, age, government ID or passport identification numbers.

Reservation information: arrival and departure dates, data on the other occupants of the reserved rooms such as names and ages, preferences (smoking room, preferred floor, etc.).

Payment information: the number of the transaction, data relating to the means of payment (bank card number, expiry date, cryptogram, processed exclusively by Adyen which only provides us with an identification token to proceed. Guarantees and payments for reservations), details of the purchase, subscription, goods or service subscribed, data relating to invoice payments such as payment terms, discounts granted, receipts, balances and outstanding amounts.

Reservations history information: the Hotel FLORIDIAN EXPRESS INTERNATIONAL DRIVE ensures that it only collects data that is strictly necessary for the purposes for which it is processed.

CCTV footage: video and images collected from our security system on the premises.

Photo ID: the photo or image on a government issued document, which is used to verify your identity.

Images or sound information: including photographs or information collected through closed-circuit television and other security measures at our property that may capture or record guests and visitors in public areas or for the protection of our personnel, guests, and visitors, where permitted by law

Non-personal data includes information that does not personally identify you or information that has been anonymized (collectively, “non-personal data”). When we combine non-personal data with personal data, we treat the combined information as personal data.

Online Analytics
We also use various types of online analytics including Google Analytics, a web analytics service provided by Google, Inc. (“Google”), on our Site. Google Analytics uses cookies or other tracking technologies to help us analyze how users interact with and use the website, compile reports on the related activities, and provide other services related to website and app activity and usage. The fulfillment of marketing operations covers:

Management of requests for rights arising from applicable data privacy law
This processing covers all the operations necessary to monitor rights requests addressed to Hotel FLORIDIAN EXPRESS INTERNATIONAL DRIVE (qualification of the request, investigations, fulfillment of specific technical operations, etc.).

Miscellaneous
Miscellaneous covers:
responding to legally binding requests from law enforcement, regulatory and supervisory authorities, or third parties;

If you apply for a position with us, we will use your personal data as necessary to determine your fitness for the position applied for, to make any relevant adjustments during the recruitment process and for equal opportunities monitoring, as well as the purposes listed above. This processing is carried out on the basis of the fulfillment of a contract, compliance with a legal or regulatory obligation, or a legitimate interest.

We may use personal data to create non-personal data. We may use non-personal data for any legitimate business purpose. We commit to not attempting to re-identify or de-anonymize any non-personal data.

Article 6. Sharing of data

We do not sell or rent personal data, and we do not share personal data for cross-context behavioral advertising. As mentioned above, by accessing or using our Services, you are intentionally directing us to disclose your personal data with the Hotel FLORIDIAN EXPRESS INTERNATIONAL DRIVE.
We handle the personal data we collect with care and only personal data which is strictly necessary will be shared with third parties.
For example, in accordance with applicable law and for the purposes mentioned in Article 5, the following individuals and third parties will likely have access to personal data:
The authorized staff of our hotel reservations, marketing, sales, administrative, logistics and IT departments, responsible for improving our Services, customer relations, market research and quality control;
The authorized personnel of our subcontractors and service providers such as, in particular, cloud hosting and storage providers, payment service providers, mail service providers, IT maintenance providers, marketing research providers;
The authorized staff of the named joint controllers, including the Hotel FLORIDIAN EXPRESS INTERNATIONAL DRIVE; and
Third parties likely to place cookies on your devices (computers, tablets, mobile phones, etc.) when you consent to them. (For more details, see our Cookie Policy).
In our relations with our subcontractors, we contractually ensure that they process the data in such a way as to guarantee their integrity, confidentiality and security.
We will also share personal data with law enforcement and regulatory authorities or other parties as required or permitted by applicable law for the purpose of:
Responding to a legal process or request, such as a subpoena, court order, or similar;
Defending, protecting, or enforcing our rights;

We will only share the personal data used to verify your identity, which includes biometric data, with your consent unless required by law.

Article 7. Duration of data retention
We retain your data only as long as necessary for the purposes described in Article 5:

For the proper functioning and continuous improvement of our Services
Personal data allowing for identification are retained for the duration of the relevant registration.
Cookies and other commercial trackers may be placed on a device for a maximum of 6 months. Beyond this period, the raw traffic data associated with an identified user is either deleted or anonymized.
The personal data collected through trackers is retained for 25 months. Beyond this period, such personal data is deleted or anonymized

For the management of customer relations and reservations
Personal data used in the context of customer relationship management is kept for the period necessary for the fulfillment of the contract. Biometric data is only used to verify your identity and is kept for the duration of the relevant reservation.
This personal data is then archived for a period of 5 years for evidentiary purposes. Invoices and accounting data issued are retained for 10 years from their issue date.
If the contract is not concluded, a prospective customer’s personal data is kept for a period of 3 years from its collection or from the last positive contact with the Hotel FLORIDIAN EXPRESS INTERNATIONAL DRIVE.

For carrying out marketing and commercial research operations
The personal data used in the context of marketing operations is retained for a period of 3 years from the end of the commercial relationship if you are a customer or from your last contact if you are not yet a customer.
In the event that you have not purchased any products from our company or have not used your account for 27 months and have not subscribed to our newsletter, we will no longer retain your personal data for commercial purposes.

For account management and carrying out associated operations including fraud prevention
Bank or credit card

Personal data relating to bank or credit cards is processed exclusively by our payment processing service providers, who only provide us with an identification token to process guarantees and payments for reservations. This processing complies with the requirements of the PCI-DSS (Payment Card Industry Data Security Standards). Personal data relating to these cards is deleted once the transaction has been completed (¨C78C, upon effective payment of the order). In the event of a subscription related to the Services, bank details are kept:
until the last payment deadline, if the subscription does not provide for automatic renewal; or
until termination of the subscription in the event of renewal by tacit agreement, subject to the applicable provisions and in particular to the information of the persons concerned before the renewal.
It is noted that for payments by bank or credit card, in accordance with applicable law, this personal data may be kept in the archives of intermediaries for the purpose of proof in the event of a possible dispute of the transaction or claim, for a period of 13 months following the debit date (period extended to 15 months for deferred debit payment cards).
In any case, personal data relating to the visual cryptogram is not stored and personal data relating to the bank card used is deleted when its expiry date is reached.
Contentious and pre-litigation actions
As part of the management of a pre-litigation, the personal data is deleted as soon as the dispute is settled out of court or, failing that, as soon as the corresponding legal action is prescribed.
The personal data collected and processed in the context of litigation must be deleted when ordinary and extraordinary remedies are no longer possible against the decision rendered.

For the management of legal requests resulting from applicable data privacy law
Personal data relating to the management of rights requests is retained for the entire time necessary to process the request. It is then archived for the penalty period applicable in the archive of an intermediary.
Miscellaneous
Personal data relating to the miscellaneous uses is retained only for as long as necessary and we use the following criteria to determine the appropriate retention period:
whether there are contractual or legal obligations that exist which require us to retain the personal data for a period of time;
whether there is an ongoing legal claim that relates to any business (or otherwise) relationship you have with us, or that is otherwise related to your relationship with us; and
whether any applicable law, statute, or regulation allows for a specific retention period.

Article 8. Exercise of your privacy rights
The following rights and choices are available to you, but some exceptions may apply based on our reason for processing your personal data and the local data privacy laws in your jurisdiction.

Depending upon the relevant jurisdiction, you may have the following rights :

the right of access and information, rectification or correction, update, completeness of your data;
the right to erasure or deletion (¨C79C, “right to be forgotten”) of your personal data, including when it is inaccurate, incomplete, ambiguous, out of date, or where the collection, use, communication or conservation is prohibited;

the right to limit the processing of your data;

the right to the portability of the data you have provided to us, when your data is subject to automated processing based on your consent or on a contract;
the right not to be the subject of a decision based exclusively on automated processing (please note that no such decision-making is currently applied by the Hotel FLORIDIAN EXPRESS INTERNATIONAL DRIVE); and
the right to define the fate of your data in the event of your death and to choose whether or not we communicate your data to a third party that you have previously designated. In certain circumstances, we may decline a request to exercise a privacy right, particularly where we are unable to verify your identity.
You may designate an authorized agent to make a request on your behalf. An authorized agent must have written documentation of their authority to act on your behalf, such as receiving: (i) a power of attorney; or (ii) sufficient evidence to show that the individual has provided the authorized agent signed permission to act on their behalf, verified the individual’s own identity directly with us pursuant to the procedures above, and directly confirmed with us the individual provided the authorized agent permission to submit the request on their behalf
